We recently connected with Eric Rubenstein and have shared our conversation below.
Hi Eric, thanks for joining us today. Can you recount a time when the advice you provided to a client was really spot on?
In general, I advise my injured clients the following:
1. Tell me all the important facts; Be sure to inform me about all the details surrounding your case and update me regarding how your doctors’ appointments and treatments are going and how you are feeling.
2. Follow your doctors’ recommendations; Make sure to attend all of your doctor and physical therapy appointments. The insurance companies and will use all lapses and delays in treatment – no matter how legitimate your reason – to claim you must not really be hurt. Do not fall into this trap by neglecting your treatment and ignoring your doctors’ advice.
3. Be cautious on your social media accounts; Keep your accounts private and do not post anything about your case including how you got injured, how you are feeling, who you believe is at fault, or anything else. The insurance companies will research your social media accounts and take information and photos out of context to hurt your case. If you already posted something about your case to your social media accounts, that is okay— tell me about it and do not delete it. Social media posts are considered evidence, so if you delete posts or photos, then it can be argued that you destroyed evidence, which could hurt your case. To be safe, it is okay to temporarily deactivate your account, but do not delete anything.
4. Don’t discuss your case with other people; This especially includes written or oral statements given to any insurance company or negligent party. An insurance company may contact you and ask you for a recorded statement, but no matter how sympathetic and kind they may sound, do not discuss your case with them without first consulting with me.
